Terms & Conditions

Please read these Terms & Conditions carefully before using our website or placing an order. By accessing www.estheclothing.com and/or purchasing goods from us, you agree to be bound by these Terms & Conditions.

“You” or “your” means the person using our website and/or buying goods from us as a consumer (for non-business purposes).


2. Scope & Acceptance of These Terms

2.1 By placing an order on our website, you agree to be legally bound by these Terms & Conditions.

2.2 You may only purchase goods from our website as a consumer and for non-commercial, personal use.

2.3 This contract is available in English only.

2.4 These Terms & Conditions apply together with:

  • Our Privacy Policy;
  • Our Shipping Policy;
  • Our Returns & Refunds Policy (where applicable);
  • Any other additional terms displayed or referred to at checkout for specific products.

2.5 In case of conflict between these Terms & Conditions and any other document on our website, these Terms & Conditions will prevail, except where mandatory consumer law in your country of residence provides otherwise.

4. Orders & Contract Formation

4.1 To place an order, you must complete the checkout process on our website and click the relevant button to confirm your purchase.

4.2 Please review your order carefully before submitting it. You are responsible for providing accurate billing, shipping and contact information.

4.3 After placing your order, you will receive an order acknowledgement email. This email confirms that we have received your order but does not mean that your order has been accepted.

4.4 We reserve the right to accept or reject your order. We may refuse an order, for example, if:

  • The goods are unavailable or out of stock;
  • We cannot obtain payment authorisation;
  • There is an error in the pricing or description of the goods;
  • We reasonably suspect fraud, abuse, or other unlawful activity;
  • Shipping restrictions apply to your destination.

4.5 A legally binding contract between you and us is formed only when we send you an email confirming that your order has been accepted and dispatched (the “Order Confirmation”).

4.6 We reserve the right to limit the quantity of items purchased per person, per household, or per order.

4.7 You must be at least 18 years old to place an order on our website.


5. Products, Made-to-Order Items & Availability

5.1 We make every effort to display our products, descriptions and prices accurately. However, minor variations may occur, particularly as many ESTHÉ pieces are crafted in small production runs.

5.2 Colours displayed on-screen may vary depending on your device and settings. We cannot guarantee that your device will accurately reflect the actual colour of the products.

5.3 All sizes, measurements and fits are approximate and small variances may occur due to the nature of fabric and production.

5.4 Some items are produced on a made-to-order basis or in limited quantities. Production and shipping times for such pieces may be longer than for in-stock items. This will usually be indicated on the product page.

5.5 We reserve the right to limit quantities or discontinue any product at any time.


6. Prices, Currency & Taxes

6.1 Product prices are primarily shown in euros (EUR). Where we display prices in other currencies, these are for your convenience only and may be based on real-time or periodically updated exchange rates.

6.2 The applicable price is the one displayed at the time of your order. We reserve the right to change prices at any time, but such changes will not affect orders already placed.

6.3 Depending on your delivery destination, prices may include or exclude VAT or other applicable sales taxes. This will generally be indicated at checkout. For deliveries within the European Union, VAT is usually included in the displayed price.

6.4 Shipping costs (if applicable), duties, taxes and other charges are shown or estimated at checkout or in our Shipping Policy.


7. Payment

7.1 We accept the payment methods displayed at checkout, which may include major credit and debit cards (e.g. Visa, MasterCard, American Express), PayPal, and other providers (such as Klarna or similar services) where available.

7.2 Payment must be made in full at the time of placing your order, unless we offer a specific alternative payment option (e.g. buy-now-pay-later) through an approved partner.

7.3 We use secure, encrypted payment gateways. While we take reasonable care to keep your payment details secure, we are not responsible for any loss you may suffer if a third party gains unauthorised access to any data you provide when accessing or ordering from our website, unless such access results from our negligence.

7.4 Your card or payment method will be charged when your order is accepted and/or dispatched, as indicated during checkout.

7.5 If payment is not successfully completed, we may cancel your order and, if the goods have already been dispatched, request that you return them or charge you through alternative means, subject to applicable law.


8. Shipping & Delivery

8.1 We ship worldwide from our European warehouses, primarily via UPS Express. Detailed information on shipping destinations, rates, carriers, processing times and estimated delivery times is available in our Shipping Policy on our website.

8.2 The estimated delivery time will usually be stated on the product page, during checkout and/or in your Order Confirmation. These are estimates only and are not guaranteed.

8.3 Delivery will be made to the address you provide at checkout. Please ensure that this information is complete and accurate. We are not responsible for delayed or failed deliveries resulting from incorrect or incomplete addresses.

8.4 Once the goods are delivered to you or a person you designate, the risk of loss and damage passes to you.

8.5 If the courier is unable to deliver your parcel (for example, if no one is available to receive it or customs charges are not paid), the shipment may be returned to us or held. Any additional costs (e.g. re-delivery fees, storage charges, or return freight) may be charged to you, depending on the circumstances and carrier policies.

8.6 We are not responsible for delays caused by events outside our reasonable control, including but not limited to customs delays, carrier disruptions, strikes, severe weather or local holidays.


9. Customs, Duties & Import Charges

9.1 International orders may be subject to import duties, taxes, and brokerage or handling fees levied by the destination country’s customs authorities or carrier. These charges are not controlled or determined by us.

9.2 Unless explicitly stated otherwise at checkout, any such charges must be paid by you (the recipient) and are not included in the product price or shipping cost charged by us.

9.3 Customs policies vary widely from country to country. For detailed information, please contact your local customs office before placing an order.


10. Right to Cancel & Returns

10.1 We want you to be satisfied with your ESTHÉ purchase. If you are a consumer, you may have a legal right to cancel your order or return goods within a defined period under applicable consumer protection law. In addition, we may offer a contractual returns policy described on our website.

10.2 Unless stated otherwise in our Returns & Refunds Policy or required by mandatory law, you generally have 14 days from the date you receive your order to request a return or cancellation, subject to the conditions below.

10.3 The right to cancel or return may not apply, or may be limited, in respect of:

  • Goods made to your specifications or clearly personalised;
  • Made-to-order items where production begins after your order;
  • Items that, for hygiene reasons, cannot be returned once opened or tried on (e.g. certain underwear or swimwear), where specified on the product page;
  • Goods that have been used, worn, washed, altered, or damaged after delivery.

10.4 To exercise your right to cancel or request a return, you must contact us within the return period using the contact details on our website, providing your order number and details of the items you wish to return.

10.5 Unless otherwise stated in our Returns & Refunds Policy, you are responsible for the cost of returning the goods to us and for ensuring they are returned safely and in their original condition, including all original tags and packaging.

10.6 Once we receive and inspect the returned goods, we will process your refund within a reasonable period, using the same payment method you used for the original purchase, unless we agree otherwise with you. We may make deductions from the refund where the goods have been used, damaged or handled beyond what is reasonably necessary to inspect them.


11. Faulty, Damaged or Incorrect Goods

11.1 If you believe your goods are faulty, damaged on arrival or not as described, please contact us as soon as possible with your order number, a description of the issue and photographs (where relevant).

11.2 Where goods are confirmed to be faulty, damaged or incorrectly supplied, we will, in accordance with applicable consumer law, offer you one or more of the following: repair, replacement, or a refund (including reasonable shipping costs, where applicable).

11.3 Nothing in these Terms & Conditions affects any statutory rights you may have under applicable consumer law.


12. Website Use & Intellectual Property

12.1 All content on our website, including text, images, logos, graphics, designs and other materials, is owned by or licensed to ESTHE SA and is protected by copyright, trademark and other intellectual property laws.

12.2 You may use the website for personal, non-commercial purposes only. You may not copy, reproduce, distribute, modify or create derivative works from any content without our prior written consent.


13. Liability

13.1 Nothing in these Terms & Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

13.2 Subject to clause 13.1 and to the fullest extent permitted by law, we will not be liable for:

  • Any loss or damage that is not reasonably foreseeable at the time you place your order or use our website;
  • Any loss or damage caused by events beyond our reasonable control;
  • Any business losses, including loss of profit, revenue, contracts, data, goodwill or other commercial or economic loss, when you purchase goods as a consumer;
  • Any indirect or consequential loss.

14. Complaints & Dispute Resolution

14.1 We aim to provide high-quality products and service. If you have a complaint or are dissatisfied in any way, please contact us using the contact details on our website. We will try to resolve your issue quickly and fairly.

14.2 If we cannot resolve a dispute informally, you may have the right to refer the matter to an alternative dispute resolution (ADR) body or to an online dispute resolution platform where applicable in your country.


15. Governing Law & Jurisdiction

15.1 These Terms & Conditions and any disputes arising out of or in connection with them, including any non-contractual obligations, are governed by the laws of Greece, without prejudice to any mandatory consumer protection provisions that apply in your country of residence.

15.2 The courts of Greece shall have jurisdiction over any dispute arising out of or relating to these Terms & Conditions, subject to any rights you may have to bring proceedings in your country of residence under applicable consumer law.

16.1 We may update these Terms & Conditions from time to time to reflect changes in our business, legal or regulatory requirements, or for security reasons.

16.2 The version of the Terms & Conditions that applies to your order is the one in force at the time you placed your order. We recommend that you check this page regularly for any updates.


17. Third Party Rights

17.1 No person other than you and ESTHE SA has any rights to enforce any term of this contract.
